NinthDecimal Advertising Privacy Policy

Introduction

This privacy policy applies to NinthDecimal, Inc.’s (NinthDecimal, we, us, our) advertising, marketing, attribution, analytics, and research services (the “Services”). This privacy policy describes how NinthDecimal collects, uses, stores and discloses the information we obtain from end users (consumers, you, your) of our third-party mobile application partners. It also describes the choices and rights available to you regarding our collection and use of your information. Note that NinthDecimal also collects information about visitors to our websites, our business partners and prospective business partners. Please see our “Website Privacy Policy” for information about how we collect, store and use your information for these purposes, as well as for how to exercise your rights.

NinthDecimal is a location-based marketing company that provides advertising, marketing, attribution, analytics and research services for publishers, advertisers, marketers and other partners. NinthDecimal collects device identified location data from users that have consented to share their location data with our mobile app partners, and we use location data points to help our customers better understand their customers and their prospects. NinthDecimal is a member of the NAI and adheres to the NAI Codes of Conduct. We also adhere to the Digital Advertising Alliance Codes as applicable to our business.

NinthDecimal knows you value your privacy and we pledge to protect it and adhere to legislative regulation and industry standards for Internet and mobile advertising.

How We Collect Information

Geo-Precise Location Information: NinthDecimal works with mobile apps that offer you choices about having your location data collected. If you agree to share your location when you use a mobile application, that information can be shared with NinthDecimal for incorporation into our Services. We collect this information from mobile applications that you have downloaded onto your device, and with whom we have a business relationship with the publisher of the mobile app (direct or indirect). We may collect this information when you receive an ad, when you are using the app, or in some cases, even when you are not actively using the app and we collect the information in the background. Note that how often we collect information is controlled by you in the Privacy Settings you have set for the app. If you agree to share your location with one of our mobile app partners, we collect and process information about you such as, but not limited to, advertising identifiers (such as IDFA and AAID), precise geo-location information, app information like app name or app ID, session information, operating system, IP address, and device model. We may receive this information either directly from an SDK (Software Development Kit) or from a “server to server” transfer between NinthDecimal and our third party mobile application partners.

Advertising Information: NinthDecimal works with advertisers to serve ads, measure ad delivery, and attribute the effectiveness of advertising. We use cookies, web beacons, and pixels in connection with our advertising technology platform to collect this information. Web beacons are invisibly embedded electronic images and are about the size of the period at the end of this sentence. We use cookies to store this type of information when we serve ads onto Internet browsers. For more information about cookies and web beacons, please visit: http://www.allaboutcookies.org/cookies/. There are some advertising partners that send us the advertising information directly via a “server to server” file instead of using web technologies like cookies, web beacons or pixels. When NinthDecimal collects advertising information, we collect and process information about you such as, but not limited to, advertising identifiers (such as IDFA, AAID, cookies), third party proprietary identifiers, ad exposure information such as URL, site name, creative, publisher, and channel, precise geo-location information, session information, operating system, IP address, email address and device model. All of these technologies help us to deliver ads, count impressions, and understand ad effectiveness of advertising.

Client Information: We may onboard additional information about you directly from clients into our data set to help those clients obtain additional insights about their customers and prospective customers. The type of information that we typically onboard directly from clients about you is historical sales transaction events and loyalty information.

Third Party Information: We also collect information about you from third party data providers. The data we collect from third party data providers is typically, but not limited to, an advertising identifier, a third party proprietary identifier, and an audience segment. An example of an audience segment is a third party associating your advertising identifier as “In-Market Appliance Shopper” or “Frozen Pizza Buyer”. We may also collect age, gender and race from app publishers where you share the data or from third party data providers. We may also receive aggregated from third party data providers who provide sales transaction attribution reports. The data we collect from third party data providers is typically collected via an offline server to server file between us and the third party.

Public Information: We also collect public census information about government defined geo-shapes such as state, county and zip code. The type of information we may associate to your device from the census is an age range, race or household income. For example, if we see your device often in a specific zip code, we may associate zip code level census information such as race or household income with your device.

Business Contact Information: If NinthDecimal has a business relationship with you or the company you work for and you are authorized to sign business agreements or are a billing contact, we also collect the information on contracts, bills or other official company documents you send us. We collect this information via email, contracts and other invoice materials that you send us.

When you visit our website, we do not link the information we store in cookies to any personal information you may submit through our website, www.ninthdecimal.com.

How We Use Information We Collect

NinthDecimal uses the collected information for advertising, marketing, attribution, analytics, and research services (the Services). Note that we only deliver NinthDecimal Services in formats that have been aggregated, anonymized, or rendered geo-imprecise. Here are some examples of our Services

  1. We may use the information to serve you tailored advertising.
  2. We may use the information to create behavioral and interest based segments based on where a device has been in the past. For example, we might classify a device as a “golf enthusiast” if we detect that the device has been to golf courses or driving ranges a certain number of times over a specific time period.
  3. We may use the information to generate insights from your location history, and we may also make this information available in market research products and services.
  4. We may use the information to help measure the effectiveness of advertising campaigns and similar market research or attribution programs. For example, if you saw an ad for a particular retailer, we may use your location data to determine if you subsequently visited the retailer and then report aggregated attribution metrics about all consumers who were exposed to the ad back to the publisher or advertiser.
  5. We may also use the information to infer that one or more browsers or devices are from the same user or household, we will link those browsers and devices into a device graph.

NinthDecimal does not knowingly use information in our platform that comes from what we consider to be sensitive health information or religious information. We may create health-related segments that are inferred from data we collect but are not derived from sensitive health data (e.g. we don’t use things like medical records). NinthDecimal does not use information for employment eligibility, credit eligibility or insurance eligibility/pricing purposes.

With Whom Do We Share Information With

NinthDecimal may share and/or sell the collected information to our customers and third party partners for advertising, marketing, attribution, analytics, and research services, or to link devices and browsers into a device graph. Typical examples of our customers and third party partners are ad networks, data management platforms, data marketplaces, brands, agencies, publishers and other marketing platforms. If NinthDecimal has collected Geo-Precise Location Information on you within the last 12 months, it is highly likely that we have sold or disclosed your information to a NinthDecimal customer or third party partner for the business purposes listed above. Note that NinthDecimal only delivers NinthDecimal Services in formats that have been aggregated, anonymized, or rendered geo-imprecise.

NinthDecimal may share information with trusted third-party service providers. The type of third party service provider that we share location and advertising data with include cloud compute and data storage providers, data management software platforms, data marketplace platforms, outsourced engineering contractors, mapping software providers, and business intelligence software providers. The type of third party service provider that we share business contact information include customer relationship management software providers, companies offering tools to send emails and similar communications on our behalf, website and b2b sales analytics providers, customer billing system partners, and auditing, debugging and security vendors. These third party contractors are prohibited from using the information for purposes other than performing services for NinthDecimal.

We may disclose your information to third parties when obligated to do so by law and in order to investigate, prevent, or take action regarding suspected, or actual prohibited activities, including but not limited to fraud and situations involving potential threats to the physical safety of any person.

Finally, NinthDecimal may transfer information, including any personally identifiable information we have, to a successor entity in connection with a corporate merger, consolidation, sale of assets, bankruptcy, or other corporate change. If NinthDecimal is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Your Choices About The Information We Collect

If you don’t want the information we collect used for the purpose of serving you targeted ads while you access the third-party applications of our mobile partners, we offer a number of choice mechanisms. If we detect a browser based Do Not Track signal, we will consider the signal as your choice to opt the cookie out of targeting advertising. Please note that none of our choice mechanisms will opt you out of being served advertising. You will continue to receive generic ads but they won’t be targeted by us and we will remove opted out browsers or devices from our ad targeting device graph. Your opt-out choice will be applied only to the browser or device that has opted out.

Here are ways that you may exercise your choice to opt-out of NinthDecimal tailored advertising. Please remember this does not opt you out of being served advertising. You will continue to receive generic ads.

AdChoices Icon

In Ad Opt-Out. You may opt-out by selecting the Ad Choices icon within an advertisement served by NinthDecimal and following the instructions.

TRUSTe Privacy Application Opt-Out. You may also opt-out of targeted advertisements on mobile applications from NinthDecimal by using the TRUSTe Privacy Application; you may download the TRUSTe Privacy Application by visiting your App Store, or by clicking here for Apple iOS or here for Android.

Mobile O/S Opt-Out: We honor the mobile device settings for Android and Apple iOS devices. To exercise this opt-out, please visit the privacy settings of your Android or iOS device and select “limit ad tracking” (Apple iOS) or “opt-out of interest based ads” (Android). For devices where we are able to see that such a selection has been made, we will not use information collection from that device to deliver targeted advertising.

Mobile Location Choices: If you’d like to adjust your setting regarding the use of precise location data by third parties such as NinthDecimal, you may do so via the privacy settings on your device. This can either be done globally across all apps by turning off Location Services, or for specific apps. Mobile applications that collect precise location information that we partner with all offer mechanisms to control the collection and use of precise location information. Please note that these choice mechanisms won’t impact previously collected precise location information.

California Consumer Privacy Act (“CCPA”)

Note that if you decide to opt-out using the Choice mechanisms above, we will consider that an opt-out of the sale of data under CCPA.

Residents of California are granted additional rights under the California Consumer Privacy Act

  • You have the right to request a copy of the information NinthDecimal has collected about you
  • You have a right to request that we delete the information NinthDecimal has collected about you
  • You have the right to request that we stop the sale of your information to our partners

If NinthDecimal has collected Geo-Precise Location Information on you within the last 12 months, it is highly likely that we have sold or disclosed your information to a NinthDecimal customer or third party partner as part of our Services. If you would like to request a copy of the information that NinthDecimal has collected about you, or if you wish NinthDecimal to delete the data that we have collected about you, you can download a request form here. The request form is an affidavit where you will attest that you have the legal right to request the information. You will need to fill out all required pieces of information, sign the document and return it to us via email. Once we receive your request, we will verify the request and contact you via email to confirm receipt within 10 days, and provide the status of your request within 45 days. You can also get the same information on how access the form by calling 1-800-563-1580. To protect your privacy, note that NinthDecimal will only fulfill verified requests for information.

Please note that a request to delete data is not the same as opting out of future data collection or being included in NinthDecimal services in the future. In order to opt-out, please follow the opt-out instructions above.

European Economic Area

NinthDecimal’s advertising solution is focused on the North American marketplaces and does not knowingly process the personal data of data subjects located in the EU. To the extent we are made aware that our advertising solution contains the personal data of an EU data subject, we will take reasonable steps to remove the data from our systems.

Security

We follow generally accepted standards to protect the information we collect such as encryption, both during transmission and once we receive it. No method of transmission, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

How Long is the Data Stored?

NinthDecimal retains the data it collects through its data and advertising solutions for a period of up to 13 months. After this time the data is anonymized, aggregated and then stored for analytical purposes.

Tracking of Children

NinthDecimal does not knowingly track the personally identifiable information of people under the age of 16 or knowingly track information from sites directed to people under the age of 16.

Updates to Privacy Policy

We may change or update our privacy policy at our discretion. If we make changes to this Privacy Policy, we will notify you by posting a prominent announcement on our Site so that any changes are easy to find. We will obtain your consent before making any material changes to information we collect and the manner in which we use it. If we make any material changes we will notify you by means of a notice on this Site prior to the change becoming effective. We, along with our third party partners, use Web Beacons/Gifs. This is a clear graphic image of 1×1 often referred to as clear gifs, that help us better manage content on our site by informing us what content is effective. Clear gifs have a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages. We do not tie the information gathered by clear gifs to our customers’ personally identifiable information.

We along with our third party partners also use JavaScript, which is a dynamic object oriented computer programming language. This is used to understand user behavior on our website and is used for analytics purposes only.

We along with our third party partners use E-Tag’s. This is a technology that is part of the standard HTTP protocol that allows validation of temporary storage (cache) of our pages and images. This technology helps NinthDecimal provide a better website experience by serving cached ads to return visitors.

(“NinthDecimal”) maintains the Web site located at www.ninthdecimal.com and allows visitors to use it subject to the following terms and conditions (the “Terms”). As a condition to using portions of the Site, you may be required to register as a member of NinthDecimal.com, and receive a password. You shall provide NinthDecimal with accurate, complete and updated registration information. Failure to do so shall constitute a breach of this Agreement, which may result in immediate termination of your account. You agree not to disclose or share your password with any third party or use your password for any unauthorized purpose. You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify NinthDecimal of any unauthorized use of your registration or password.

6. Your Privacy Policy.

If you are an operator of a Wi-Fi network or a publisher of a mobile application, you will have, publicize and abide by a privacy policy that discloses that third parties may be using cookies, web beacons and other technologies to collect information as a result of ad serving through your services. If you collect, process or disclose location-based information in connection with your services, you must adhere to a legal and appropriate means for obtaining express consent from your end users and make appropriate disclosures in your privacy policy.

7. Venue Only.

If you enter into correspondence or engage in commercial transactions with users or other third parties in connection with your use of the Site, such activity is solely between you and the applicable third party. NinthDecimal shall have no liability, obligation or responsibility for any such activity. You hereby release, and agree to hold harmless, NinthDecimal from all claims arising from such activity.

8. Termination.

NinthDecimal, in its sole discretion, may terminate your registration or use of the Site for any reason, including, without limitation, if NinthDecimal believes that you have violated or acted inconsistently with the letter or spirit of these Terms. NinthDecimal may also in its sole discretion and at any time discontinue providing the Site, or any part thereof, with or without notice. NinthDecimal is not liable to you or any third-party for any termination of your access to the Site.

9. Indemnity.

You agree to indemnify and hold NinthDecimal, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Site, your connection to the Site, your violation of these Terms, or your violation of any rights of another.

10. Dealings with Advertisers or Partners.

Your correspondence or business dealings with, or participation in promotions of, advertisers or partners found on or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser or partner. You agree that NinthDecimal is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers or partners on the Site.

NinthDecimal may provide, or third parties may provide, links to other World Wide Web sites or resources that are beyond NinthDecimal’s control. NinthDecimal makes no representations as to the quality, suitability, functionality or legality of any sites to which links may be provided, and you hereby waive any claim you might have against NinthDecimal, with respect to such sites. 12. No Warranty.

Without limiting the foregoing, NinthDecimal does not promise or warrant to you that any aspect of the Site will work properly or will be available continuously. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights, which vary from state to state.

13. Liability Limits.

IN NO EVENT WILL NINTHDECIMAL OR ITS SUPPLIERS OR CO-BRAND PARTNERS BE LIABLE FOR ANY LOST PROFITS OR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THE SITE, ITS SERVICES OR THIS AGREEMENT. FURTHER, IN NO EVENT SHALL NINTHDECIMAL OR ITS SUPPLIERS OR CO-BRAND PARTNERS BE LIABLE TO YOU IN AN AMOUNT GREATER THAN $500. Some states do not allow the foregoing limitations of liability, so they may not apply to you.

14. Modifications to these Terms.

NinthDecimal reserves the right to modify these Terms periodically, at its discretion. If we make changes, we will notify you by posting a prominent announcement on the Site, so that any changes are easy to fine. Any such revisions, amendment, or modifications will be effective upon the posting of such Notice. Continued use of the Site by you after such Notice is posted constitutes your binding acceptance of such revisions, amendments, and modifications. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SITE.

17. General.

All matters relating to your access to and use of the Site are governed in all respects by the laws of the State of California as such laws are applied to agreements entered into and to be performed entirely within California between California residents, without reference to conflicts of law provisions. You and NinthDecimal each agree to attempt in good faith to resolve any bona fide controversy or claim arising out of or relating to these Terms or the Site by confidential mediation under the then-current CPR Mediation Procedure before resorting to arbitration. Mediation of the controversy or claim will be conducted on an agreed date by a single, agreed upon, independent mediator in San Francisco, California, or another agreed location. Any bona fide controversy or claim not resolved within a reasonable period of time by discussion or mediation will be finally resolved by confidential, binding arbitration in accordance with the CPR Institute for Dispute Resolution Rules for Non-Administered Arbitration by a sole arbitrator appointed in accordance with those rules. Any such controversy or claim shall be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party. The place of the arbitration will be San Francisco County, California (unless you and NinthDecimal otherwise agree prior to the initiation of the arbitration). The arbitration will be governed by the Federal Arbitration Act, 9 U.S.C. Section 1-16, and judgment on the arbitration award may be entered into by any court having jurisdiction thereof. The award of the arbitrator will be final and binding upon the parties without appeal or review except as permitted by California law. The arbitrator will not be empowered to award damages in excess of compensatory damages. Any claim by either party will be time-barred unless that party commences the arbitration within one year after the claim arises, provided that this time limit shall be tolled during any discussion or mediation of the claim. Notwithstanding the foregoing, either party may seek any interim or preliminary relief from a court of competent jurisdiction in San Francisco County, California as necessary to protect the party’s rights or property pending the completion of arbitration. By using the Site, you consent and submit to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California. If any portion of these Terms is deemed unenforceable by a court of competent jurisdiction or an arbitrator, then that portion will be enforced to the maximum extent possible and the remaining portions of these Terms will be given full effect. NinthDecimal’s failure to act in a particular circumstance does not waive the ability to act with respect to that circumstance or similar circumstances. NinthDecimal will be excused for any failure to perform to the extent that its performance is prevented by any reason outside of its control. No agency, partnership, joint venture, employment or franchise relationship is intended or created by these Terms. NinthDecimal may require registration or payment to continue use of any aspect of the Site at any time. These Terms constitute the entire agreement, and supersede the provisions of any other agreements or understandings (oral or written), between the parties with respect to your access to and use of the Site and the subject matter of these Terms.

Opting Out

If you don’t want the information we collect used for the purpose of serving you targeted ads while you access the third-party applications of our mobile partners, we offer a number of choice mechanisms. If we detect a browser based Do Not Track signal, we will consider the signal as your choice to opt the cookie out of targeting advertising. Please note that none of our choice mechanisms will opt you out of being served advertising. You will continue to receive generic ads but they won’t be targeted by us and we will remove opted out browsers or devices from our ad targeting device graph. Your opt-out choice will be applied only to the browser or device that has opted out.

Here are ways that you may exercise your choice to opt-out of NinthDecimal tailored advertising. Please remember this does not opt you out of being served advertising. You will continue to receive generic ads.

AdChoices Icon

In Ad Opt-Out. You may opt-out by selecting the Ad Choices icon within an advertisement served by NinthDecimal and following the instructions.

TRUSTe Privacy Application Opt-Out. You may also opt-out of targeted advertisements on mobile applications from NinthDecimal by using the TRUSTe Privacy Application; you may download the TRUSTe Privacy Application by visiting your App Store, or by clicking here for Apple iOS or here for Android.

Mobile O/S Opt-Out. We honor the mobile device settings for Android and Apple iOS devices. To exercise this opt-out, please visit the privacy settings of your Android or iOS device and select “limit ad tracking” (Apple iOS) or “opt-out of interest based ads” (Android). For devices where we are able to see that such a selection has been made, we will not use information collection from that device to deliver targeted advertising.

Mobile Location Choices. If you’d like to adjust your setting regarding the use of precise location data by third parties such as NinthDecimal, you may do so via the privacy settings on your device. This can either be done globally across all apps by turning off Location Services, or for specific apps. Mobile applications that collect precise location information that we partner with all offer mechanisms to control the collection and use of precise location information. Please note that these choice mechanisms won’t impact previously collected precise location information.

Browser based Opt-Out. If you’d like to opt-out of receiving targeted ads from NinthDecimal via your browser, please click here and TRUSTe will drop an opt-out cookie on your browser. The opt-out cookie tells our systems not to serve targeted advertising to that browser. Please note that if you delete your cookies, you may need to renew this opt-out choice. Similarly, this opt-out mechanism may not work properly if your browser is set to restrict cookies.

California Consumer Privacy Act (“CCPA”)

Note that if you decide to opt-out using the Choice mechanisms above, we will consider that an opt-out of the sale of data under CCPA.

Residents of California are granted additional rights under the California Consumer Privacy Act

  • You have the right to request a copy of the information NinthDecimal has collected about you
  • You have a right to request that we delete the information NinthDecimal has collected about you
  • You have the right to request that we stop the sale of your information to our partners

If you would like to request a copy of the information that NinthDecimal has collected about you, or if you wish NinthDecimal to delete the data that we have collected about you, you can download a request form here.  The request form is an affidavit where you will attest that you have the legal right to request the information.  You will need to fill out all required pieces of information, sign the document and return it to us via email.  Once we receive your request, we will verify the request and contact you via email to confirm receipt within 10 days, and provide the status of your request within 45 days.  You can also get the same information on how access the form by calling 1-800-563-1580.  To protect your privacy, note that NinthDecimal will only fulfill verified requests for information.

Please note that a request to delete data is not the same as opting out of future data collection or being included in NinthDecimal services in the future. In order to opt-out, please follow the opt-out instructions above.

In compliance with the California Consumer Privacy Act, known as CCPA, California Residents may make several requests with respect to privacy. These include:

Finding Your Mobile Device ID

Both iOS and Android devices have unique advertising identifiers, which are used to help advertisers (and a variety of other entities) track activity on those devices.

On iOS, the identifier in question is the IDFA, or Identifier for Advertising. The Android Advertising Identifier is the Android analog.

Neither identifier is particularly easy to find, and both can be reset. So while these IDs are unique, they aren’t persistent; like with cookies on the web, users ultimately have control over whether they can be tracked using these identifiers.

iOS

The simplest way to locate your iOS device’s IDFA is to use a third-party app called The Identifiers. The sole purpose of the app is to display a device’s IDFA, so all you have to do is install and open to see your IDFA.

Android

Finding your Android Advertising Identifier is a more straightforward process. Open up the Google Settings app and navigate to Ads; once you do, your ID should be visible at the bottom of the screen.
